Our Sun ,Trademark Attorney..... will probably have some advice for you, but my understanding  is ,the first to use the name has a lot to do with the ability to trademark the name.

since there are statutory rights and common law rights potentially at issue, I don`t think anybody can give a simple YES or NO answer to this.  You should ask the lawyer that filed the application.

That`s like being diagnosed with a medical problem involving a complex surgical solution and saying you`d rather not speak with a doctor because you`re keeping your expenses down.
