Our production company is branching out and becoming an ad agency for local businesses. I`m assuming we need some kind of contract for customers to sign considering there`s an agreement for payment over $15,000 in exchange for work on an ad. What do I need and where can I get it (preferably without having to fork over a ton of money for a lawyer)?

The basic problem is that we can`t afford to have them pay the money after we make the ad and buy the airtime, that`s a lot of money. We`d need at least the vast majority of the money before buying airtime. But, of course, businesses will be leery of forking over that much money without some guarantee. We can make the ad before payment, but not buy the airtime. What would be the best way around this problem? Thank you so much!!!

I understand your problem. Have you ever read `Purple Cow` by Seth Godin? Maybe it will help, not with the legalities but with the overall strategy of your company. I think it will really be insightful for you and your business partners. Keep rockin` boss!

There are many sample contracts available on the internet. It would be worth your money to find one you like, make the changes that fit your situation, then pay your attorney to review it. If you do most of the work yourself, their review should be an hour or two -- and much less costly than having them do the contract from scratch OR paying them to help resolve a problem in a contract that isn`t right for your company and jurisdiction.
 
As for payment, many advertising venues expect payment up front (for ad space/time), so that shouldn`t be unusual to your clients. Perhaps you can establish credit terms with the local TV stations that give you some time to collect from your client and then pay them. You may want to make the payment schedule in your contract a down payment of perhaps 1/2 of the ad production costs, and have the remainder of the ad costs plus the media buy due prior to the ad start date.

Find a paralegal in your area.  They can draft a form for you for about $60.00.

You have 2 options.

1. Explore something cheaper than $15,000 - as some others have mentioned also.
2. Take a loan - this has its own share of risk since you are trying to establish your business - mortguaging might be difficult.

Evaluate both the options, see if you have any third option (not that I can think of) and then make a solid decision. As an enterpreneur I never believe in looking back or regreting any decision once I make it.

Very brave.  A transaction that is valued at $15,000 using a form from the internet without ANY legal advice.  A paralegal that is drafting documents based on information from a client is probably practicing law and thus breaking the law - not that any of that should matter if you can save a few bucks.
