This is one reason I love subscription businesses. You can get people to pay one month or three months in advance, and finance your whole business without borrowing.

I would like to use the Idea of pre-selling my product. As this would make it much easier to finance my new business. We figure it will cost us as much as fifty thousand dollars to get it off the ground. Each Unit I sell will sell for between $30 to $45 dollars. That's what we hope. I will need to advertise my product before I can achieve any sales also. We will start in Diabetic magazines and retired people magazines and magazines for men in the baby boomer age bracket. It is a product that many men in this age group need every night of their life. It is not a drug. It is easy  to use.

BUT, are there any laws I must conform to as to the amount of time I collect their money to the time I must fulfill their product order?.
I need to be sure I can do what is necessary in what ever time is legally made by law.

As my product most likely will be manufactured in Ecuador or Peru or Chili in South America, I must be concerned about turn around time to make, ship and prepare the product to send to the client and then to send it. I also must have the tooling, molds, ect made and checked before my product can be made. My product will be made of plastic using the injection and blow molding methods.

I have no Idea at this time how much time this will take as I must do it once to verify the time to complete these actions.

Can you give me any guidelines as to any rules, laws for doing this type of sales in the USA?

Did you sell to distributors or retail? I have been thinking about pre-selling, but it is so time consuming to contact each prospect buyer individually that I am afraid that the time spent trying to pre-sell will eat up my profit. Also, I am afraid of not selling enough to cover the cost of manufacturing, since I will have to order quite a large amount of each product in order to keep the unit cost affordable.

I have not sold to any one yet.
I have not even made my product to sell yet.
I will be advertising in Magazines first. Then the Internet. Then to Hospitals and nursing homes and to men over the age of 50 years. As these are the people who have a need that my product fulfills.
I have been using my invention / product since 1988 and now I am going to put it on the market to sell.
I have got a patent pending number and I have contacted plastic manufactures in Ecuador to make my product.
My wife lives in Ecuador and it is much less costly to make this in South America, than in the USA.
But, I have not spent any money yet to make the molds or any other tooling to manufacture my product.
 
I would like to advertise first to see what the market will do with my product.
I know there is a great need for my invention and I should have great sales of it, once I start advertising it.
but, I worry if there are any laws in the USA that demand that I deliver the product in a short amount of time.
How many days or weeks do I have before I infringe on any laws of this nature?
I need to be sure I have enough time to manufacture then prepare my product  for sales and then send it to the people who have prepaid. NO one seems to have any idea if there are any laws that state the amount of time I have once I collect their money to the time I must make delivery on the sold item.
Do you know of any such laws or where I could learn of such a laws if there is such a  law.
Mr. Richard Geller says we should take advantage of doing this type of marketing, but, he does not warn his readers of any laws of this type.

In other words, How long do I have before I must send the product to the purchaser who has already paid for their item.

I will need to have it tooled, manufactured, shipped  to me from South America, most likely by boat and then I will need to send these items to the buying customers. CAN ANYONE GIVE ME ADVISE ON THIS SUBJECT?

As a consumer, if I bought and paid for something, I would expect to receive it "immediately" - within a few days. If I was told that it would be "months" before it could be delivered, I would tell the credit card company to reverse the charge. Said credit card company will not be pleased if you have very many charge backs and will probably cancel. If you can't cover the charge backs - they will likely take legal action.

I can give you the name of a good attorney - but my bottom line is:

I would not do this unless I informed every customer that there would be a long wait for their product.
