Hmmm got to admit it this is the first time I have heard this comes off as a scam....I think that is a hard factor to get past when it comes to software that benefits people that sell on the web. As far as the lay out goes I have been working on this with several people from start up and other design web sites to come up with the look of the web site. Also I have been listening to pod cast after pod cast on here and trying to put into effect what they say. The main items in the pod cast have been.
1. Each sentance less then 15 words
2. less then 7 lines per paragrah
3. one action item per line
4. one idea per sentence
5. Express not impress
6. shorter words are better
7. Whats in it for the consumer
8. Strong begining
I have tried to put all of the above items into effect for my web site but yet it comes across as a scam.
Would love some feedback on how to get a point across about software in the first 9 seconds of reading and not come across as if your scamming someone. Guess for now I will scrap this and go back to the drawing bord and forums and see were this went wrong.

I think your layout is fine, however, I think the underlying problem has more to do with your copy (content). I`m a guy who has tons of customers, but I have no earthly idea what your software does. I`ve read it 3 times so far and still don`t really understand how the concept works.
Forget about the rules you`ve read, they`re only guidelines. You should focus on conveying how your software can help us business owners. What are the benefits we get from using this software? Right now, I have a hard time understanding the purpose of it altogether.
Help Your Customers Stay In Touch...
1. What does that mean?
2. Help them stay in touch with who?
3. Do customers want to stay in touch with me, or is it the other way around?
You message is rather confusing and I think you should scrap it all and start over (with the content, not necessarily the layout).
You need to provide a compelling reason why a business owner like myself would want this software...
Example... if you insist on using that customer angle, this may be a better option:
Discover How to Motivate Your Customers to Stay in Touch With You!
Fact: It`s 10 times easier (and cheaper), to get your existing customers to purchase from you again than it is to acquire a new customer....
(I don`t know what the stats are, but that would grab my attention more versus what is up there now).
I think you`re trying to sell your software a little too early without putting up how we benefit.
