I want to start a company from my apartment, preparing foods that are not cooked in any way. Are there laws or legislation against working and selling food from your home? Even if you do not use a stove, oven - - no heat and all organic food sources. Do I need a license or a sanitation grade to do this? I want to prepare foods that I sell to restaurants and also ship online.

The FDA has recently been making massive changes regarding regulation of all sorts of things. One new regulation involves the classification of "food preparation sites." Those would include backyard gardens, farmers` markets, and anywhere else that provides a connection between food and the public.

As WebJunky says, spend some time on the FDA site. You may also have to consider whether or not your apartment management allows what you`re doing.

i am curious because my mother makes a living cooking as well!

If you are going to sell anything that other people will consume you can bet that you will need to be approved and or inspected by local or state authorities.  Check with your local or state Board of Health.

It can be a challenging but rewarding experience.

Food Preparation all types is very highly regulated not only by the Feds but states as well.  USDA is involved as well as FDA. There are reason for this Allergies, communicable Diseases like Hep A and Such.

In Oregon for example you really need a seperate commercial Kitchen set up. You cannot have any pets in your home at all or you will never get a license. Be prepared for lot of inspections before a license is granted and regular visits where they can make you change the way you do thing at any time.

I had a friend that owned a candy store and practically every month the inspector make her change something about her labeling.

If you have a Small Business Development Center in your area I suggest you contact them and use them as a resource they have counselors to help you.
