Hi all, I appreciate any advice anyone can give.

Before forming my company I did a search to see if the business name I was interested in was taken and couldn't find anything so I went ahead with the name.  Now after a little time has passed I did find another business with a similar name, so I was hoping I could get some advice on what my options are in this situation.

Let's say my business is called "Legendary Toys & Games LLC" and I sell apparel, toys, and accessories from various pop culture licenses.  The other business is called "Legendary Collectibles LLC" and sells similar (but not all the same) items (also, these are not the actual names of the companies, but close enough in style to get the point across).  Because the products sold and the names are similar, I'm assuming I'll need to change the name of my business to avoid any troubles in the future.  So my questions are:

1.  Am I right in thinking I need to change the name, or are the names different enough for me to continue operating with what I have?

2.  Do I actually need to change the name of the company, or can I keep it as "Legendary Toys & Games LLC" but do business as a different, more unique name?

3.  If I need to change the name of the company, who all do I need to get in contact with?  I'd assume the secretary of state, the IRS, the bank I use, and any vendors I use.  I figure there's also probably a fee involved, but that it would depend on the state.  Is there anyone I missed?

I guess I wasn't looking hard enough when I formed the company, so I really do appreciate any help anyone can give with this situation.  Thanks again.
