I have an idea for a business I want to start. I have been working on the marketing and business plan. I am ready to start contacting web developers. What should I do to make sure the web developers don`t steal my idea when I talk to them about the kind of site I want to develop? Thanks!
 
Should I get a NDA?

Gosh, that`s a new one on me. In all the years I`ve been doing websites no one`s ever asked me to sign a NDA. I`ve never even heard of an instance where a web designer stole someone else`s web business idea.

I wouldn`t sign a NDA before even discussing a project because it would be a red flag that I was dealing with a problem client. The last thing I need is to spend the rest of my career walking on eggshells in case, heaven forbid, something resembling that client`s business idea shows up on another client`s website.

If it`s that much of a concern, you could give some of your company`s equity to the designer in exchange for a promise that he/she will never put anything resembling  your business idea on another client`s site, even if that other client came up with the idea independently and is just looking for someone to execute it. It`s worth some equity because what you`re asking is potentially an enormous problem for any designer. It would require screening all future clients and could potentially result in a lot of sales turned away in order to remain compliant with the NDA. It`d be like asking a painter never to paint someone else`s house the same color as yours before revealing what color you want it painted. Who in their right mind would agree to that?

Web designers do what they do because they don`t want to do something else... most probably including your business idea.

Okay...well I was talking with this one designer and he was like I like you idea. I should do it myself and he laughed. I am thinking uh oh. Should I do business with him? He is a friend of mine but now I am paranoid that he will take my idea and run with it. I was thinking this could be a problem with other web designers.

I would have to think that unless your idea is something rather simple and quickly profitable (which is unlikely in most cases...), I would doubt anyone would really devote himself to it and make it happen.  It takes a certain passion for an idea to actually become something. 
 
There are millions of great business ideas.  I really doubt your friend will ever do anything with the idea.  I`m sure there are examples of ideas being stolen, but not enough to be paranoid about it.  You`ll likely just scare off others who will be passionate about your idea with NDAs and junk like that..... 
 
I say do as much work on the idea as you can yourself first.  You likely have a vision of how it all will work.  Read this book: Getting Real.  http://gettingreal.37signals.com/  It is a great book ABOUT good web development. (free to read online now) The most important point of the book is that the actual programming is the last thing you should be thinking about.  Which means you could probably "develop" most of your web site without involving others.  It would save time, money and help keep the design true to your vision.
 
Anyway, I`m rambling a bit and it probably isn`t exactly what you are asking, but best of luck with your endeavour.

Thanks for the response!  I think I am just being overly paranoid. I am sure he could build a site himself but the actually running of it. I am not sure how into it he would be. I think everything will be fine.

Exactly my point.  Your site requires your love and attention.  Only you will provide it long term to make it work.
 
If it is your idea and it keeps going through your head, you will do it best anyway...
 
I have a site that I have improved and updated each and every day for nearly 4 months now.  No one else would have done this because it doesn`t make much money (yet).  But being my own idea, I have a passion for it and want it to succeed.
 
(Seriously check out the book.  It is for non-programmers and it applies to so many things..)

You should not have any problems but our software company signs a lot of NDA`s before we start on proprietary content development for our client`s. I think it would be a smart move to ask the web developer to do this. Remember, it`s business!

I`ve had this doubt myself. Thanks for bringing it up. Because I`m not capable of creating a site I`ve got to rely on a developer. He/She knows how to do it.  Obviously the doubt creeps in.
I think the best way to avoid trouble is to get a patent or copyright for the idea. I don`t know the entire procedure to do it. Or if it is worth the trouble. But it keeps off anyone from snatching the idea.
