hey Tyler,

have you checked the waybackmachine or time machine online that shows who was first?  with this you can easily file suit.

Did you contact the website already? You can email them and they should give you credit. You also have to be wise that having a copyright is your right. You can contact Google about it as well so that they can help you.

Yes, Copyright is automatic when the work is created. You need to determine if the work is truly a copy, which it sounds like it is, or merely derivative. This is a serious matter, and you can sue for damages and the offending party can face serious consequences.
