Zoning does come into play.  Also you must hold state certification as a Certified Sanitarian.  This is a 5 year license in my state and requires continuing classes. 

Home cooking is NOT allowed unless your home kitchen has been converted into an NSF environment and approved by your local county health department. 

Your health codes will also determine the level at which you are approved which will determine what you may and may NOT offer on your menu.  All menu items must be approved by your county health department. This is a matter of public safety and sanitation. 

Many people don`t realize the level of responsibility when cooking and serving food to the public.  If not done properly and according to accepted safety and sanitation guildelines, you can make people very sick and even cause death.  

When customers come into my restaurant they can see I am licensed, my kitchen is licensed, my people are licensed, my equipment is NSF approved and my kitchen is regularly inspected by the county as these licenses and inspections are posted as required.
