One potential downfall of not seeking legal counsel before developing a brand or marketing can be seen in the case involving registration of the trademark SKINNY CEREAL. The Board found the mark SKINNY CEREAL merely descriptive of the goods and refused to register. In re Peace Mountain Natural Beverages Corp., Serial No. 77326673 (June 30, 2009) [not precedential].
