As you`ve done PPA or RPA, just do it again to get priority day.  You may get lucky if it`s a clear-cut case.  Examiners are more linient with pro se applicant.  If prosecution becomes serious, you can ask for help from the pros then.  Being "patent pending will help with your funding efforts as investors need such assurance about IP, even prefer issued patents.

I"m new to this thread, which seems to be a few years old by now.  I am an experienced Ph.D. USPTO registered patent agent with over 30 patents of my own (23 issued), and about 70 patents that I have drafted for others.  I do work in electronics, software, biomedical technology, and biomedical devices.  I have also had quite a bit of experience in international filings, freedom of action searches, and litigation support.

I try to do "big law firm" quality work at a fraction of the price, and some of my work is in fact published under the name of some big law firms and assigned to large corporations.  Check out my website at http://www.patentassociate.com .

While not meaning to be harsh here, I do not suggest that people use a patent agent - paricularly one working alone.  The reason is that most I know do not understand the litigation process - because they either have no experience in litigation and/or are not licensed to do litigation.  Without that, it is tough to understand the "big picture" needed to draft an application that will hold up in litigation.

You need to be specific with what exactly on your website you want to trademark. If it is a logo, then you need to show items (website pages, newsletter, letterhead, or business card) that are incorporating the logo. You cannot, trademark the website itself, unless it is a specific, distinctive look as to differentiate your company. The patent and trademark office has a booklet on the basics of trademarks (www.uspto.gov - 1.800.786.9199). You could also go to your local bookstore and purchase Nolo Press's book on Patent and Trademark. If you try to do it by yourself, it can take a long time, so I suggest getting the assistance of a trademark attorney - a little payment now will save you much more down the road. Good luck

James, I have a question for you. I have been working on a children's book (along with website, and creating this whole world for these characters) what should I do to protect my ideas.
