Web Design Buyer's Guide

Step 7: Web design contracts

Just about every web marketing company operates with contracts with their clients. Be aware of any web designer or web hosting companies that do not operate without a contract. A contract will protect both the client and the vendor and will explain important information about the project’s process, costs and specific guidelines. You will want to protect your business and your rights when working with a vendor, in the case that you have a dispute with the company.

Important factors of a web design contract

Your web design contract should include information on:

Ownership

It is common knowledge that the website, domain name, content and images on the website belongs to the business owner, right? This is not always the case as some web designers retain the ownership rights and copyrights of completed projects. In some minor cases, the design company will require the ownership of your domain name. Make sure to go over this information during the contract process.

Costs and payment schedules

Costs and payment schedules should be clearly explained within the contract. This information should include down payments, incidental costs and performance benchmarks that will explain when future payments need to be fulfilled. Other costs, such as in-house logo design, content writing and hourly rates should be included within the contract. If you decide to work with a web design company that offers support after the website is launched, the pricing of these services should also be included in the contract. Unplanned costs are never good so make sure you are well aware of how much money you will be spending on your website.

Timelines

Timelines instilled by the web design company should accurately explain the website making process and will have a clear concept of how long the project will take to be completed. If the web designer fails to meet these deadlines explained in the contract, there should be consequences on their side, because the delays were not your fault. Make sure to keep an open line of communication with the designer so delays are never because of your actions.

A web design contract is a necessity before any designing begins. Make sure the contract is thorough and clearly understood, especially if your ecommerce web design is complex and comprehensive. Even minor web designs should be based on a contract so each side is protected.
