More like your opinion or take on where should I go, before I hire an expensive lawyer (witch eventually I`ll do)

 

I am creating a site where I would be showcasing and selling prints, digital downloads and CDs. I`ll show and sell not only my work, but other photographers work.

 

The idea is to get all those thousands of images you are saving on your hard drive (CDs, DVDs, etc) and put them on a place where people can see them and maybe (just maybe) buy them.

 

So here are my questions:

1) What kind of paperwork should I be signing with the selected photographers? Meaning, I would be using those images in banners, flyers and anything I can use to promote the site (and the photographer work by association). If the image sells, I`ll be getting money for something (images) that are not mine (although eventually I`ll pass most of that money to the owner of the images.

2) Is there an online resource where I can get a `canned` contract for something like this? (like legalzoom.com but for photographers).

 

Again, no necessary legal advice, more like your take or experience on something like this.

Good Morning Rocke,
 
In all honesty, you should speak with an attorney.  I realize that it  is costly, but you need to protect yourself legally.  You need to have very specific contracts drawn up when using items that belong to others.

you need a diagnosis of the situation, which takes time and thus money.  that`s why it costs money.

Speaking as a non-attorney, I agree 100%.  I obtained some generic blank client contracts online that looked like a good foundation and then paid an attorney to look over the contracts.  I`m glad I did!  He found/closed some loopholes that had been missed by the original creator.
