I have an LLC and am considering hiring a couple of good people as 1099 subcontractors.  Is there special paperwork that I have to file with the government and are there any implications to doing so that I should be careful with?

Yes,

You need to be careful how you define and manage their positions.  Their can be a fine line between and employee ( for which you would have to pay payroll taxes ) and independent contract employees.

I am not familiar with that, but will be glad to help you with the legality of background checks if you need it.

Hi JWagn, in order to classified a workers as IC you must observe the IRS guidelines, you shall as the questions Who perform the work, what will be done, how it will be done and when it will be done. Also Check the questions the IRS ask in form SS-8, you don`t need to fill this form but the questions can help you about to have a clear idea in classified your workers.

You must provide them the form W9 in order to issue the form 1099 at the end of the year.
