 Is it illegal to place a trademark emblem next to your company slogan even if it has not been trademarked yet?

Give us an example. Sometimes you could get in trouble if you pulled the information from another website with out the owners permission.

Trademark rights arise from actual usage of the mark in commerce, not from registration of the mark.  If you want to establish what is known as "common law" trademark rights, versus state or federal registration of the mark, and you want to have third parties see that you`re establishing those rights, you can add the "TM" symbol after the mark itself.  The circled "R" is only used when a federal trademark registration has been obtained.
