Int’l Warranty Policy - how to structure? - please help!

Hi, Fellow Members,

I have a growing business in Canada that has attracted interested distributors from overseas - industrialized countries.

What are the key elements of a warranty clause in the exclusive distributorship contract? What are the pitfalls of drafting such a clause?

In North America we generally ask people to return the product they wish to have replaced. However, it will be too costly to do so in the oversea situation. How should I arrange the warranty issue with my distributor in overseas? Who should be responsible for what and how to be compensated?

Is there anywhere I could find a sample clause for this purpose and situation?

Your kind help, thoughts and advices will be greatly appreciated.

I am certainly stumped on this question. Maybe someone else will have some better answers. The only thing I can suggest, is searching for international warranties, using Yahoo, Google, or some other search engine.

Searching for "international warranty" brought up several example warranties for different products and companies. Maybe some of these like this one could give you an idea of how to begin structuring your warranty.
