Dear fellow members,
Please consider the importance of a web designer contract when you are hiring a designer to build your site.  This can be done very easily- the library is full of books with great sample contracts.  It`s important to protect yourself and your ideas.    Check into the company you plan to hire.  Check out their references and make sure they have experience building the type of site you require.  There is a big difference in skill required to build different types of sites.

Having a contract with a web designer is important, but knowing what the contract says is critical.  The most important issues are that you must own all of the intellectual property of the website, not the designer.  Technically, if he designs the website, and there is no agreement to the contrary, he could argue that he owns the images and content of what he authored under copyright law. 

Also, critical, who registered the domain names?  I have seen worst case scenarios of the designers volunteering to register the domain name.  Then after a dispute, the designer refuses to relinquish the domains back to the business owner.  There are a lot of subtle issues involved with hiring a designer so make sure you are aware of these preliminary issues.

make sure there is an assignment of all rights to you.  a lawyer that works in patent law can help.

I think it's depend on the client agree to exercise due diligence when writing text and producing images for the site. They must be able to substantiate all claims and representations and would be liable for all trademark, copyright, etc.
