I’m being sued by previous employee, help! LEGALIZED EXTORTION

It is my understanding that the only way we’re going to get outstanding representation is if the case is going to net a major amount of billable hours. Am I wrong?

I am looking for a law firm that can help my company and me in resolving an employment claim. I have an interest in settling this out of court, but this former employee is stacking the big guns up (SF- Bushnell, Caplan, Fielding, & Maier, LLP, yes she`s done this before) and my natural reaction is to stack our big guns up as well so we have a fighting chance. But we need to work smarter not harder. We do not have any capital to drag this out in court.  I don’t mind doing the heavy lifting and paying my attorney an expensive hourly rate for VERY focused counsel. I’m stuck between a rock and a hard place, please help.

Beyond the above facts, this employee`s claims are totally unfactual and frivolous. This person has open claims with her former employers. Yes, she`s done this before. Yes, she knows the system. Who`s the victim here? LEGALIZED EXTORTION!!!!

I understand your feelings.  In my previous position as a human resources manager I faced a few challenging employee lawsuits and claims.  It doesn`t seem fair to the employer at times.

If you are confident that the claim is unfactual and frivolous and have documentation to support it, I`d say spend the expense to fight it.  In that scenario, the odds are in your favor that the court will dismiss the case in the early stages. (Of course every situation is different - and I don`t know the details in your case.)

I have worked with Littler also and agree with Lori above.  I have also worked with http://www.sheppardmullin.com/ Sheppard Mullin and found them to be competent.
