I am looking to open a restaurant in a year or so.  I am currently a private chef.  I operate out of my house and do not have a business license, insurance, any of that stuff, (shoot me), Henry Ford had a lot less to deal with when he started.  I am looking to sell some products related to my resturant at a local Farmers Market.  They will not be perishavble, or require cooking on site.  Spices, Beef Jerky, Gourmet Food Mixes, things of that sort.  For the Farmers Market I need Insurance, Resale certificate, business liscence etc... I know it is illegal to cook food in my house and sell it to the public.  I am willing to take that risk.  My question is, risk aside, will I be able to get all of the above at my home address, I think I will tell the insurance I am a distributor of gourmet food, not a manufacturer.

Don`t know if you would be able to get insurance coverage for that, but if for some reason you do get insurance as a distributor when in reality you are a manufacturer, I`m willing to bet my bottom dollar that if you ever make a claim it would be denied because the insurance contract was drawn under false premises.

Just another note, you`ll probably need a permit from the Health Department too, for the Farmer`s market.  They will want to know where the food is manufactured. Have you looked into what is needed for a commercial kitchen? It does sound risky how you`re doing it.

This is one of the reasons why Americans are finding it so hard to start a business. We should support Peter Schiff as he seriously wants to make it easier for Entrepreneurs by removing many of the taxes.

In my state, you have to have a local business license to sell a "tangible" product.  This includes selling through a farmers market.  And, if you make 66 percent or more of your yearly income from the sale of these items, you have to get a state business license.

To get either license you have to answer a lot of questions.  Your home may also have to be inspected since this is the point of manufacture.

I think if you doesn't carry license for the business from home, then you cant get the insurance cover.
