I am at a stage of my start-up where I need to hire people on a commission based only. I guess I can hire them as consultant. They do not then need to be on a payroll, pay taxes from company (of course they pay taxes on their own), etc. They get paid for the service they provide.

Are there restriction to the title I give them if they are consultant? For example, do I have to call them sales consultant on the contract instead of sales director?

I am looking for a free legal form online to enter their incentive in a legal form. Any recommendation? I cannot afford a lawyer to make the document.

Go to www.lawdepot.com they have free legal forms for just about anything and everything.  You can fill out and save; they are also state specific (contracts that basically abide by your state laws).   Totally free

Great question and great response Juanita. The terms used is indeed very important - an independent consultant, free lance, contract worker are not considered employees of the company. I think I will review the law depot site myself.

Not to sound like a self-serving attorney, but be careful with those "free" forms.  You get what you pay for.

Actually, it’s not the first time I have heard about such an issue, but I’m afraid I wouldn’t be able to give you a correct answer. Though I have asked my wife about that and she has told me that you should definitely ask an injury lawyer about that, as he must know exactly the way you are supposed to handle it.
