Hello all!

Any help would be very much appreciated! There is a certain brand currently in the states; very well know in its market and a reasonably small chain. I have recognised a gap in the UK market for such a service, but would like to use the name/follow the same business plan as this already-formed company. The service I am looking into is one which rides on the success of a well known name/ technique which is why I am so interested in using it. However, I have looked into franchises, but the foresaid company does not currently offer these, and by researching them they are completely different as the main company provide training, equipment etc. But I would be quite happy doing all these things on my own. Is there any way to draw up a contract allowing me to use the company name in return giving them a % of the net sales I would make? I have managed to get the email address of the owner and would like to contact him with my idea ASAP. I am currently at university and would not actually look into it in any depth until after graduation (summer) but would like to get the ball rolling as soon as. If anyone has any knowledge of any set up such as the one above let me know!

It sounds as though what you are looking to do is license their name and certain portions of their intellectual property for a specific geographic area. One of the great things about being the owner of a business is that you have the power to make any decision you want.

If the franchise agreement between the owners and the franchisees in the U.S. specifically prohibits a licensing arrangement outside the U.S., that may stop your discussions. However, because it is an international arrangement that you seek, you may have more luck. Certainly the worst thing the owner could say is "no."
