For Web Developers and Hosts - Getting sued for not Spam filtering?

I find myself in a unique situation.

A new customer came onboard and we launched a website - one he is admittedly happy with, but the small hosting company we are paired with does not offer spam filtering. This is not an issue with the 20+ other customers (of same and larger size) we have currently hosted.

He has been raising Cain about "being offended" by the spam messages and demands we doing something about it. While trying to explain it isn`t an area we work with, but I did offer some "friendly ideas" as to free solutions that may work. They didn`t.

I`ve offered help in finding another host to provide services and even allowed his to stay on our servers for free until we find another provider. Through some "bickering" emails, he has decided to pursue legal action due to the spam messages.

Has any other hosts or developers run into something this crazy?

Yes, I have legal counsel and yes, I am in an LLC. Not looking for legal advice, but some other "war stories".

How about having them sign up for Google Apps

Yes, Google Apps is great. I use Google App for my email. Much easier than managing it myself.
