I`m in a situation where I have to terminate an employee.  Should I give them written notice verbal notice both?  What is the standard i should follow?

I would give them verbal notice, an exit interview and written notice that they sign.

Are you terminating (i.e. sacking due to poor performance or something like that) or making redundant?

You have to be careful otherwise you might face a tribunal.

If you are `sacking`, you need to have evidence on why. Have you verbally told them they need to improve their performance? Have you given them a chance to improve their work, behaviour, etc? You have to verbally and in writing give them an ultimatum - either you improve or you have to leave. Then is there is no improvement, again verbally and in writing tell them they have to leave.

If you are making them redundant, you have to give them notice that you are making them redundant and then a week later make them redundant providing a notice period of whatever is in their contract, normally 4 - 16 weeks.

That is how it works in the UK, anyway.

I agree with the others.  If the employee can claim ANY form of discrimination - age, sex, religious, orientation, disability, etc., you had better have your tracks covered and make it clear - IN WRITING and have them sign it.  It needs to be clear that their termination is based on performance and be able to give proof that they didn`t meet their goals or that they were not meeting your performance expectations.  These days, if the employee has an ingrown toenail that prevents them from walking to the copier without discomfort and you fire them because the report wasn`t done on time, they can find an attorney SOMEWHERE who will sue you under the ADA.
