This blog is copying content (looks like auto blog) and is getting higher search result positions then my blog from where it copied the post in google organic search.

I made this post on 13th oct
http://www.webdesign2day.com/2011/10/13/page-flip-and-curl-with-jquery.html

and is reposted by this blog on 17th Nov
http://www.bayduvinsolutions.com/flip-and-curl-with-jquery/

And now when I search in google with the post title I see his blog on 2nd page while mine is on 3rd. Now I changed the page title slightly to see if I can get better results.

First off, both of these websites have only been live for a couple of months. So you shouldn't even be worrying about search engine positions yet. Google only updates PageRank about once every quarter.

From what I can see, it looks like you bought backlinks, which is a bad idea after the Panda update. Links from low-quality sites get you ranked down, and you're lucky you're not in the sandbox already for doing that. That's probably why your PageRank is the same as his, even though you have over 2,000 backlinks. Also, I noticed you were commenting on blogs with no-follow links so you're not getting any benefit from Google by doing that.

Here's why I think he's ahead of you, based off what I see at a quick glance:

  1. His homepage has way more textual content than yours and it's obviously a lot more fresh because he's stealing content and reposting it.
  2. Your link structure is horrible, you need to remove the date, month and year  from you urls. His links to blog posts are coming straight from his root domain.
  3. His homepage HTML is clean with a high percentage of textual content, yours is filled with links to other pages, which gives search engine crawlers a hard time.
  4. You have way more ads above the fold than he does, which hurts you because of the Panda update.

Duplicate content can be a hassle even though it’s not necessarily a punishable offense. It’s as legal yet ripe for spamming abuse as bold tags, to be honest. Besides which, because Google is all about gathering unique and original results, the search engine has a tendency to group together pages that essentially contain the same material into just one result, which sometimes leads to a low SERP.

If you think, that blog owner has stolen your content then you can report it to Google and you can see Google is removing lot of websites from top search positions under DMCA act.So if you are the original owner of that content then you should take necessary action.
