Hello,

I have been looking into starting a line of skin care and cosmetics products.  I am somewhat familiar with cosmetic product formulation and composition, but I am unsure about the use of certain active ingredients and the patents that may protect them.  

A particular ingredient that I would like to use in an anti-aging product is Epidermal Growth Factor (EGF), which has apparently already been patented for cosmetic use by Dr. Gregory Bays Brown.  However, despite his patent, other cosmetics companies are using EGF in their formulations for the exact same purpose and type of product.  Is this legal?  Is there any way that these companies can be using EGF for the same purpose as stated in the patent but somehow finding ways to avoid prosecution?    

I would like to know if active ingredients such as EGF can be patented for cosmetic use despite the fact that they are naturally occuring chemicals.  Can someone patent a specific ingredient, or do they have to patent its specific use or production method?  As well, would it be possible to circumvent such a patent by suggesting a different formulation and/or method of production for the compound containing the ingredient?   In general, can cosmetic ingredients that are used in a wide variety of products be used by any cosmetics company?  
 
As well, I have noted what appear to be many patents for cosmetic ingredients and their uses that overlap.  For example, I have found a patent that claims right to topical compositions of EGF in a polyoxyethylene polymer vehicle and another patent for EGF in a cellulose polymer and yet another for EGF in a crystaline form.  Is it really just a matter of changing the medium that the EGF is in to get a new product and hence an new patent?

These are specific questions that can`t really be answered without some research.  A similar question would be, "I have a headache - do I have a tumor causing my headache?"  It is a completely legitimate question - just requires a physical exam, some type of brain scan, etc....

I started my Cosmetics Company in 2007 after working for many years on my own Anti Aging Moisturzer and decided to proceed with a Trademark my for the name of my company.  I used the actual Trademark and Patent Office and my Assigned Attorney was Ms. Emily Carlson.  She took care of my Trademark and it has been published but I have not taken it any further as far as trying to protect my Concept, Jars with Decor or any patents at this time.  I`m wondering if this is enough?   The reason I`m asking is because my husband had a friend who is  supposedly a Marketing Expert and he wanted me to give him 20% of my company in exchange for him taking care of my Website and any Marketing.  I felt that was fair and told him so but we never drew up any documents, signed anything or exchanged any money.  I felt uncomfortable once I gave him some information concerning my Company and some of my Formulas but only gave him 1/4 of my Ingredients I use.  All of a sudden two weeks ago he got very angry because I wouldn`t okay the Website he produced.  I tried to explain to him that a lot of what he had on the Website is not correct, possibly an infringment and  possible slandering statements and I would not okay.  He was so angry because I didn`t love it that he no longer is involved in my company, thank the Lord and I`ve moved on.  His last email to me was, "I will no longer be involved", which was what I wanted to hear anyway.  This entire situation took place in the last 2 weeks. The Website he put together he even had the nerve to write his name as CEO with a photo of HIM!  He also used MY jar.  He wrote to me and said, "I will no longer be involved"!  Now I hear he`s taken some of my samples, getting them analyzed and going to go forward with his own company in Cosmetics.  All of my Friends are in shock.  Plus he`s approach two of my girlfriends and is trying to do the exact same thing with them and they aren`t giving him the time of day.  He did go as far as getting my one girlfriends design that she is in the process of getting a patent but he went ahead and sent it to CHINA!  Supposedly he was once a very successful Marketing expert but since his divorce 2 years ago and this economy it`s as though he`s desperate. 
 
I should have never trusted him even though I`ve known him for at least 10 years.  I will move forward and continue to work on my Company but wanted to know if I need to do anything else as far as protection.  I was hoping someone may know what else I can do? 
 
On HIS Website he even has titled the Website with MY COSMETICS COMPANY NAME and it`s so embarrasing because he`s 62, wrinkled and is trying to be the new pitchman of the Internet like the Informercial guy that sells everything for $19.99!  He thinks he has my formula but I sent him a dummy formula.  I felt something wasn`t right so I  never gave it to him.  He does however have samples but I`ve changed that as well because the other was not finished anyway.  He thinks he has something, but he doesn`t have the actual Formula.
 
This guy even got mad because he wanted and did change the name within my name and is about to go live and sell this cream for $25.00 a jar!!!  There`s no way I could sell my Jars for $25.00 with everything I have in my Formula! 
 
Can you give me an idea what I may can do?  I don`t want to say anything to  him yet because he hasn`t done anything as far as going live with my Anti Aging Cream but he`s definetly got a problem.  Now I know why his wife left him, and his girlfriend is finished with him.
