Confusion over United trademark?
Original Company first registers and uses the trademark UNITED for “financial services, namely, check cashing, money transfer and money order services.”
New Company comes along and wants to register and use the trademark which includes the words “UNIDOS….AL ALCANCE DE TU MANO” which is apparently translated something like “….United….Within Your Reach” in Spanish. The services of the New Company are “financial services, namely, money transfer services.”
What is the likelihood that consumers would see the two trademarks in commerce and conclude that the two companies are somehow related or affiliated? Is the likelihood of consumer confusion kind of high or low?
