Well I guess the old adage of live and learn rings true. My plans for starting Cabo Loco has been shot down. I have just done a search for trade marks and the Cabo Loco name is taken. I was planning for it to be for a line of clothing, but it is registered to a company that makes tortilla chips and salsa. I would love some input as far as possiblities.  Can I change the name to Kabo Loko? Does it have the same ring?

No, Kabo Loko does not have the same ring, IMHO.

hmm you should remember this may work against you as people may perceive you as trying to piggyback on someone else`s success, and or your product may become really successful and then resent that someone else is using the same name.

That said, you can still use `Cabo Loco` even if it is trade marked. TradeMarks work by name/product/industry for instance `Kodak` is a well known and TradeMarked film and camera brand, but that doesn`t mean I can`t use it. I could start selling car tires under the TradeMark `Kodak` because it is in a different industry and my company is not attempting to pass itself as the same Kodak company that sells film and cameras.

Do a search for something like `Dell` most often associated with a computer manufacturer and TradeMarked as such, and you`ll see that there area  a myriad of other companies with the same name and TradeMark in other industries.

a trademark attorney can have a search done before any application is filed.

Thanks for your help everyone.  I think I have a way around it by simply adding the word "Apparel."  That should clearly separate me from tortilla chips.

I like the "Cabo" name.  It suggests fun, sun and a touch of sophistication.

I immediatly think Cabo San Lucas and Cabo Wabo Tequilla.

Cabo means Cabo San Lucas which is a popular Mexican tourist area at the southern tip of the Baha peninsula. Great place...my wife and I had a chance to visit earlier this year.
