It depend to company. But, my company's rule is okay for smoke at lunch hour. My company give more attention about performance at work.

i think he can, a boss can do anything he or she wants if they want you to live your job.

but a great solution is the electronic cigarettes lots of people use them

no and yes, you can smoke in your own property, but you are parked on their property so it is their private property also. Go off property to smoke.
