Independent Contractor:
A person or company retained to perform work for another, often under a written contract, whereby control is subjected to the end result and not as to how the work is performed. As opposed to an employee who receives direction on what, when and, to some degree, how to do a job. Care must be used in the classification of workers as either employees or independent contractors. What distinguishes them is the degree of control the employer has over the activities being performed. Specific definitions of employee and independent contractor exist in IRS publications. After the fact, the IRS can determine that a person was actually an employee. Serious tax consequences may apply if an incorrect classification is made.Post Reply
